Bankruptcy

Chapter 7 – The Fresh Start

In a chapter 7 bankruptcy, the individual is given a clean slate and all debt can be wiped clean. This is a way for those with mainly credit card debts and very little in the way of assets and income to start over and start building a better financial future.

Chapter 13 – The Re-organization

In a chapter 13 bankruptcy, the individual is allowed to reorganize their debts and obligations and repay a portion of the debts over the span of 3-5 years. At the end of the plan payments, the remaining debt is forgiven. This area is geared for debtors with leveraged assets like homes and who have larger earning capacity. This chapter allows those with homes to file for bankruptcy and still keep their homes if they can make the mortgage payments and plan payment.
